A recent court ruling against the KY Dept. of Agriculture states that hemp derived products, including delta-8 THC products, can lawfully be sold in KY. This resulted in a permanent injunction being issued to law enforcment for taking action against delta-8 retailers and possessors.
Intoxicating Cannabinoids, as defined, require registration.
1. Delta-10-tetrahydrocannabinol (Delta-10-THC);
2. Delta-9-tetrahydrocannabinol (THC) with less than three tenths of one percent (0.3%) Total THC;
3. Delta-8-tetrahydrocannabinol (Delta-8-THC);
4. Delta-9-tetrahydrocannabinolic acid A (THCA-A) with less than three tenths of one percent (0.3%) Total THC;
5. Delta-9-tetrahydrocannabivarin (THCV);
6. Delta-9-tetrahydrocannabivarinic acid (THCVA);
7. Delta-6-tetrahydrocannabinol (Delta 6);
8. Hexahydrocannabinol (HHC)(-);
9. Tetrahydrocannabiphorol (THCp); and
10. Tetrahydrocannabinol (THCM);
Non-intoxicating cannabinoids, as defined, do not.
Beverages (0.3% ∆9 or less): 5; these products will be regulated by ABC after SB 202 passed on 3/25/25; "Cannabis Infused Beverages" a) means a properly permitted adult-use cannabinoid liquid product intended for human consumption that has intoxicating properties that change the function of the nervous system and results in alteration of perception, cognition, or behavior and shall not contain more than five mgs of intoxicating adult-use cannabinoids per twelve (12) ozs; and b) shall not include 1) medicinal cannabis as regulated under KRS Chapter 218B, 2) any type of hemp tincture, and 3) any product containing solely nonintoxicating cannabinoids.
