Montana has an overly broad definition of THC, which makes no exemptions for THC when found in hemp. Additionally, Montana's controlled substances langauge prohibits synthetic cannabinoids.

“ "Synthetic cannabinoids" has the meaning provided in 50-32-222 and includes any cannabinoids produced artificially, whether from chemical synthesis or biosynthesis using recombinant biological agents, including but not limited to yeast and algae.” Mont. Code § 80-18-101

In January 2025, the MT Cannabis Control Division released guidance indicating "The sale of synthetically derived cannabinoids are prohibited in Montana as May 22, 2023, under House Bill 948 and codified in 16-12-117 MCA."

After the Governor signed HB 49 on 4/7/25, regulators now have authority to enforce against synthetic cannabinoid products and the state law broaded that definition even further.
